General conditions of Sale
1. The premise
1.1.The present general Conditions of sale (“GCS”) govern the purchase, distance from the user (“Customer”) of the products promoted on the site www.ilturbante.it (the“Site”), owned by the soc. Fair Fashion Srl (the“Company”), with registered office in Via Stalingrado 71/5b – 40128 – Bologna, italy.
1.2 The Customer declares and guarantees that the purchase of products is intended for use strictly personal and unrelated to the professional activity or commercial activity.
1.3 these CONDITIONS of sale (available on the website and accessible to anyone) should be carefully examined by the Customer before completion of the procedure for the purchase of products and/or services through the Site.
1.4 The submission by Customer of a purchase Order (“Order”) for a product on the Website implies the total acceptance and unconditional of the GCS. These CONDITIONS of sale shall be considered an integral and substantial part of the purchase contract.
1.5 Fair Fashion Srl reserves the right to modify at any time the present GTC. In any case, the CONDITIONS applicable to an Order are always the ones accepted by the Customer at the time of submission of the Order.
1.6 Fair Fashion Srl may change at any moment the assortment of the products offered for sale and information related to them, without any prior notice.
1.7 Fair Fashion Srl aims at giving on his Site constantly updated information. However, it is not possible to ensure that the Site is completely free of any errors. The Site may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability of the Product, and the Product information sheet. Fair Fashion Srl reserves the right to correct any errors, inaccuracies or omissions including after an Order has been sent and also reserves the right to change or update information at any time without prior notice.

3. The object of the contract
3.1 With this contract, respectively, the Fair Fashion Srl sells and the Customer buys from a distance through telematic instruments, the tangible movable property indicated on the site “ilturbante.en” in the specific section dedicated to the online sales.
3.2 The products available for online marketing are described in the relative informative cards. The image accompanying a product may not be perfectly representative of its characteristics but to differ for color, size and accessory products.
3.3 these CONDITIONS of sale do not regulate the supply of services or the sale of products performed by third parties that use direct links to the Site through banners or other hypertext connections/links. Fair Fashion Srl will in no case be liable for the supply of services promised by third parties or for the execution of e-commerce transactions between customers of Fair Fashion Srl, and third parties.
3.4 Fair Fashion Srl reserves the right not to process orders received from users who are not “Customers”, as well as any other Order which does not comply with the business policy of Fair Fashion Srl.
3.5 The products are in conformity with the legislation applicable in Italy, in force at the time of the Order.
3.6 The bids shall be valid for all the time they are published on the Website and within the limits of available stocks.
3.7 For products not immediately available in the stores of Fair Fashion Srl the offerings on the Site are valid subject to availability. The directions on the product availability will be provided to the Customer at the time of sending an e-mail confirming receipt of your Order.
In any case, and in the event that, after the sending of the Order, you may receive an unavailability total or partial, of the product, the Buyer will be immediately informed by e-mail of the unavailability of the product and of the total or partial cancellation of the Order.
3.8 The sales prices shown on the Website are inclusive of I. V. A. and are related only to products sold online. The price applied will be that in force at the time of Ordering and indicated in the e-mail confirmation of your Order, without regard to increases or decreases in prices, even for promotions, may have intervened then.
3.9 The transportation charges, except where specified are not included in the purchase price indicated, but are calculated at the time of conclusion of the purchase process before payment. The transport costs will be charged according to the weight and quantity of the products and on the basis of the destination of the Order. The total amount of the charges will be visible before proceeding with the confirmation of your purchase. However, Fair Fashion Srl, during some period of time or for the whole year, we reserve the right to remove the costs of transport (in these cases free of charge) when it reaches a certain amount, linked to the purchase of one, or the sum of multiple products that are part of the same order.
4. Conclusion and the conclusion of the contract
4.1 The Customer declares to have full capacity to act and enter into a contract for the purchase of products on the Site on the basis of the GCS.
Fair Fashion Ltd shall not in any case be obliged to check the ability of the act of visitors and Customers of the Site. In the case in which a person not having the necessary capacity to act (for example, a child) enters an Order on the Website, without prejudice to the responsibility of their parents or legal guardians for the Order and the relative payment, Fair Fashion Srl may refuse to accept the Order.
4.2 Each Order placed by the Customer entails acceptance of the GCS, and constitutes an offer to buy the products on the website “Ilturbante.it”.
4.3 orders are subject to acceptance of Fair Fashion Srl, which reserves the right, at its sole discretion to reject the Order, even in cases in which:
(i) orders may not be executed because of an error in the information provided by the Customer at the time of placing the Order (billing address incorrect; shipping address insufficient or wrong) or if they are provided by the Customer misleading information;
(ii) an error has occurred on the Site relating to the products ordered, for example an error relating to the price or description of the product as shown on the Website;
(iii) products ordered are no longer available on the Site.
4.4 Fair Fashion Srl reserves the right to suspend or cancel the execution of an Order and/or delivery, irrespective of the nature and the progress of the execution, in the case of non-payment or partial payment of any sum due from the Customer, in case of problems with your payment, or in the case of fraud or attempted fraud relating to your use of the Site, also with reference to previous Orders.
4.5 In case of refusal of the Order, Fair Fashion Srl will notify the Customer, within 30 working days from placing the Order, the inability to accept the Order. The Customer can check the details of your Order and correct any errors before confirming/sending of the Order.
4.6 With the confirmation of the Order, the Customer declares to have knowingly accepted the contents and conditions of the Order in question and, in particular, these CONDITIONS of sale, prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the Customer.
4.7 The sale will be concluded only at the time of acceptance of the Order by Fair Fashion Srl by sending an e-mail confirming receipt of the Order to the Customer.
A second e-mail will be sent to the Customer at the time of shipment of the Order; the shipment of the Order, Fair Fashion will charge the amount of the Order.
4.8 Fair Fashion Srl recommends to the Customer to retain the e-mail received on paper or electronically. The Client is informed of the fact that the above e-mail will be sent to the email address indicated at the time of creation of the Account and/or the preparation of the Order itself.
Fair Fashion Srl will not be liable in case of entry of the e-mail address is not valid, and/or the non-receipt of confirmation e-mail of the Order for reasons not directly attributable to Fair Fashion Srl. In this case the sale will be regarded as definitive. The Customer may, however, exercise the right of withdrawal as referred to in article 8 of these general sales CONDITIONS.
5. Payment
5.1 The Customer warrants to Fair Fashion Srl that he has the necessary permissions to use the payment method chosen for the Order at the time of sending the Order.
5.2 If the Customer has a PayPal account you can choose this mode of payment. In this case, the Customer will be automatically redirected to the website of the soc. PayPal to proceed with payment.
Where provided, the Customer may provide payment by credit card through the PayPal site, using the following cards are accepted by the site.
5.3 The Customer may, alternatively to the previous point, to provide for the payment of the order transmitted by bank transfer, details of which are listed on the Site, and reiterated in the e-mail confirmation of the Order.
The Customer is required to send to Fair Fashion Srl copy of the transfer to the address indicated in the order confirmation email. Such documentation constitutes an essential and integral part of the Order.
5.4 Fair Fashion Srl will not accept any other mode of payment than those indicated in points 5.2 and 5.3.
5.5 All Orders are payable in Euros. Any bank charges will be the sole responsibility of the Customer (in the case of a refund) and will not be calculated at the time of the Order.
In the case of non-payment or delayed payment of the Order by the Customer, Fair Fashion Srl reserves the right to apply interest on arrears in an amount equal to the legal rate of interest from the tenth business day following the date of the Order or of the notification of rejection of bank payment.
5.6 Fair Fashion Srl reserves the right, in any case, the right to suspend or cancel, at its sole discretion and at any time, the execution of an Order and/or shipment of the ordered products in case of non-payment or partial payment of any sum paid by the Customer in case of delayed payment or in case of fraud or attempt of fraud through the use of the Site, as well as in relation to previous Orders.
5.7 In the context of the fight against fraud on the Internet, the information regarding the Customer's Order may be transmitted to a third party authorized by law or designated by the Fair Fashion Srl only for the purpose of verifying the Customer's identity, the validity of the Order, the mode of payment used and the place of delivery.
5.8 No financial transaction will take place directly on the Site, but only through the telematic platforms PayPal or credit institutions involved in the transaction.
Fair Fashion Srl therefore declines all responsibility as would occur during the stages of payment.
No data related to the credit card or the bank account of the user will be prompted during the payment process on the Site ilturbante.it
5.9 The issue of an invoice is not compulsory, unless requested by the Customer at the time of effecting the transaction, as indicated in art. 22 of D. P. R. of 26/10/1972 n. 633.
By sending the Order to Fair Fashion Ltd., the Customer agrees to receive the invoice/receipt in electronic format. After the issuance of the invoice, it will not be possible to make any changes to the data indicated in the same.
The purchase invoices are sent via e-mail to the e-mail address indicated by the Customer at the time of purchase (or registration) on the Site.
6. Delivery of the products
6.1 The products ordered by the Customer according to the present GTS will be delivered to the address indicated by the Customer in the delivery address on the Order.
6.2 Fair Fashion Srl sends, via the designated carrier, in all the Italian cities and of the European Union
6.3 orders will be processed as soon as received. Fair Fashion Srl undertakes to deliver the products in the shortest time possible, usually within 24-48h from receipt of order. If the product is not available at the time of the order, an email will be sent to the customer informing him on the date of delivery.
6.4 The goods shipped shall be controlled and delivered to the carrier intact and without flaws. Fair Fashion Srl can not be held responsible in any way for any delays or damages attributable to the fault of the carrier.
6.5 The purchased products will be delivered to the address indicated by the Customer at the time of the Order.
7. Responsibility
7.1 Fair Fashion does not assume any responsibility for inefficiencies attributable to causes of force majeure or unforeseeable circumstances, even where employees from malfunctions and disruption of the Internet network, in the case in which it fails to execute the Order within the time stipulated in the contract.
7.2 Fair Fashion will not be liable for any damages, losses and costs suffered by the Customer as a result of the failure to perform the contract for causes not attributable to it, and unless this is due to the fact or omission of a Fair Fashion, having the Customer shall only be entitled to a full refund of the price paid and any additional charges incurred, when duly documented.
7.3 Fair Fashion cannot be held responsible for the information, data and any technical inaccuracies or of other nature that may be contained in the site, if they have been communicated by third parties and have been verified by Fair Fashion according to the criteria of ordinary diligence.
8. The intellectual property
8.1 The trademark Fair Fashion Srl, de “ilturbante.en”, the figurative marks and not present on the Site, the images, illustrations and logos and any content contained on the Site (including, without limitation, these CONDITIONS of sale) are the exclusive property of Fair Fashion Srl and/or of the respective owners of the intellectual property rights to the same, without access to the Website and/or the conclusion of contracts of purchase providing the Customer any rights in the same.
8.2 reproduction in whole or in part, modification or use of these trademarks, illustrations, images and logos, or any other content on the Site, for any reason and by any means, without the express written permission of Fair Fashion Srl and/or of the respective owners of the intellectual property rights to the same is strictly prohibited.
9. Applicable law and competent jurisdiction
9.1 these CONDITIONS of sale, and all sales of products on the Site are governed by Italian law, regardless of the place of dispatch of the Order.
9.2 Any dispute relating to the existence, interpretation, execution or termination of these GTC and/or of the contract concluded between the customer and Fair Fashion, will be donated, in the absence of the transaction, to the exclusive jurisdiction of the Italian courts competent according to the place of residence or domicile of the Customer, if located in Italian territory.
10. Validity and duration of the general conditions of the contract
10.1 The present general sales CONDITIONS, as amended from time to time, will apply to all of the time in which the products will be offered for sale on the Site and until the expiration of the terms of the legal and contractual guarantees.

11 Promotions
Fair Fashion reserves the right to make special conditions of sale or promotions on Products on their site. The conditions applied to the promotions will be governed from time to time by Fair Fashion by means of special communications to its Customers.
For what will not be covered otherwise, shall be deemed applicable to the present General Conditions.
12 Registration
To make the purchase of the products, it is not necessary to register.
However, the registration and the registration to the mailing-list allows you to take advantage of any discounts or promotions if the Fair Fashion Srl decides to make them.
Registration is free, fast and does not imply any purchase obligation.
The procedure for registering on the Site requires filling out an electronic form, whose fields must be filled in with the Customer's personal data and his e-mail address. These data will be processed in accordance with the current legislation of privacy protection. Following registration, the Customer will own a personal account which can be accessed through a user-name and a password to access confidential. The assignment of these credentials provides to the Customer an anonymous identification. Customer care will not disclose your password to any third party for any reason.
The Customer will be held responsible for any irregular actions and behaviors in contrast with the regulations in force or these General Conditions committed by anybody who uses it in his stead the personal account. The Customer is required to report in a timely, Fair Fashion, the possible theft or loss of password, and any misuse by third parties of the account or password of which he has knowledge.
